1. Introduction / Introducción

These terms govern the use of our website and the booking of our property in Santa Pola located at Avenida de Cristóbal Sanz 10, 03130 Santa Pola, Alicante. By booking, you agree to these conditions. Este documento regula el uso de nuestra web y la reserva de nuestra propiedad en Avenida de Cristóbal Sanz 10, 03130 Santa Pola, Alicante. Al reservar, usted acepta estas condiciones.

• Registry / Registro: Valencian Tourism Registry under License Number VT-498730-A and National Registry ESFCTU00000303700008638000000000000000000VT-498730-A8.

2. Legal ID Registration / Registro de Huéspedes (RD 933/2021)

In compliance with Spanish Law, all guests must provide valid ID data via our secure check-in portal prior to arrival.

• Es obligatorio por ley registrar a todos los huéspedes (incluidos menores) antes de la llegada. El acceso a la vivienda está sujeto a este registro.

3. Occupancy / Ocupación

Our apartment is optimized for families and small groups.

• Adult Limit: Maximum 4 adults recommended per booking.

• Total Capacity: Maximum 6 guests (e.g., 4 adults + 2 children).

• We reserve the right to cancel bookings that exceed the 4-adult limit or unauthorized guests.

• Máximo recomendado de 4 adultos y capacidad total de 6 personas. No se permiten grupos de más de 4 adultos.

4. Payments & Security Deposit / Pagos y Fianza

• Booking: Your reservation is confirmed once the initial payment is processed.

• Security Deposit: A €350 hold is authorized as a security deposit. This is released within 7 days of departure, provided no damage, smoking, or party violations have occurred.

• Se requiere una fianza de 350 € que se desbloquea tras la salida si no hay daños ni infracciones.

5. House Rules / Normas de Convivencia 🤫

To ensure a peaceful stay for you and our neighbors:

• Quiet Hours / Horario de Silencio: 22:00 – 08:00.

• No Parties & No Smoking: Strictly prohibited. Violation results in immediate eviction and loss of deposit.

• Check-out: 12:00 PM.

• Prohibido fumar y realizar fiestas. Respeten el descanso de los vecinos.

6. Cancellation Policy / Política de Cancelación

• Standard: Full refund if cancelled 40 days before arrival;

• Consulte su confirmación de reserva para ver los plazos específicos de reembolso.

7. Nature of the Stay / Naturaleza de la Estancia

• Tourist Use Only: This property is rented exclusively for short-term tourist and recreational purposes. Under no circumstances is it permitted to use the property as a permanent residence, for professional activities, or for local residency registration (Empadronamiento).

• No Tenancy Rights: The guest acknowledges that this agreement does not create a landlord-tenant relationship under residential leasing laws.

• Uso Turístico Exclusivo: Esta propiedad se alquila exclusivamente para uso turístico y recreativo de corta duración. En ningún caso se permite el uso de la vivienda como residencia permanente, para actividades profesionales, ni para el empadronamiento. Este contrato no otorga derechos de arrendamiento de vivienda habitual.

8. Duration of Stay & Legal Classification / Duración y Clasificación Legal

In accordance with Valencian regional regulations (Decree Law 9/2024), the legal nature of this agreement changes based on the length of your stay:

• Stays of 1 to 10 days: These are classified as Tourist Accommodation and are governed by tourism laws.

• Stays of 11 days or more: These are classified as a Seasonal Rental (Arrendamiento de Temporada) under the Spanish Urban Leasing Law (LAU). For these stays, the guest is required to sign a specific Seasonal Rental Contract prior to arrival, confirming the temporary nature of the stay and providing a permanent home address.

De acuerdo con la normativa vigente (Decreto Ley 9/2024), la naturaleza de este contrato varía según la duración de la estancia:

• Las estancias de 1 a 10 días se consideran Alojamiento Turístico y se rigen por la normativa de turismo.

• Las estancias de 11 días o más se clasifican como Alquiler de Temporada bajo la Ley de Arrendamientos Urbanos (LAU). Para estas estancias, es obligatorio que el huésped firme un contrato de temporada específico antes de su llegada, confirmando la temporalidad del alquiler y facilitando su dirección de residencia habitual.

9. Liability & Jurisdiction / Responsabilidad y Jurisdicción

This agreement is governed by the laws of Spain. Any disputes shall be settled in the courts of Elche / Alicante.
